1. Acceptance of Terms

By using heybachu.com (“Bachu”, “we”, “our”), you agree to these Terms of Service. If you do not agree, do not use the service.

2. Eligibility & Parent Requirement

• Bachu is designed for children in Grades 2-8, but accounts must be created by a parent or legal guardian.
• By creating an account, you represent that you are the parent or legal guardian of the child and are legally able to accept these Terms on their behalf.
• You are responsible for all activity under your account and child profiles.

3. Service Description

Bachu provides AI-assisted educational tutoring conversations for children. The service is currently in beta and may change frequently as we improve the experience.

5. AI Limitations & Safety

• AI responses may occasionally be incomplete, inaccurate, or unsuitable. While we work hard to ensure quality, AI is not perfect.
• Parents should supervise their child's use of the service.
• Bachu may filter, moderate, or block content to improve safety.
• Bachu is an educational tool, not a crisis monitoring service, mental health tool, or emergency service. Safety features are provided on a best-effort basis.
• Bachu is not a substitute for professional medical, psychological, or therapeutic advice. If your child is in distress, contact a qualified professional or emergency service.
• AI-generated content should not be relied upon as the sole source of information for any important decision, including academic, health, or safety matters.

6. Acceptable Use

You agree not to:

• Use Bachu for unlawful, harmful, abusive, or fraudulent activities
• Upload or submit content that violates the rights of others
• Attempt to reverse engineer, disrupt, or compromise system security
• Use automated scraping or high-volume data extraction without permission
• Circumvent safety controls or access controls

7. Account Security

• You must keep your login credentials secure.
• You must promptly notify us of unauthorized access or suspected misuse at hello@heybachu.com.

8. Privacy & Child Data

Our Privacy Policy explains how data is collected and used, including child data protections and parent rights.

9. Intellectual Property

• Bachu and its content, software, branding, and materials are protected by intellectual property laws.
• We grant you a limited, non-exclusive, revocable right to use the service for personal, non-commercial educational use.

10. Feedback

If you provide feedback or suggestions, we may use them to improve Bachu without compensation to you.

11. Beta Service & Availability

• Bachu is currently in beta. Features may be modified, suspended, or discontinued at any time.
• We do not guarantee uninterrupted or error-free operation.

12. Suspension & Termination

We may suspend or terminate access if:

• These Terms are violated
• We suspect misuse or legal risk
• Continued operation is not feasible

Parents may request account deletion at any time according to our Privacy Policy.

13. Disclaimer of Warranties

To the maximum extent permitted by law, Bachu is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, Bachu AI and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or educational outcomes arising from the use of the service.

15. Indemnity

You agree to indemnify and hold harmless Bachu AI and its operators from claims arising out of your misuse of the service, violation of these Terms, or violation of the rights of others.

16. Governing Law & Disputes

These Terms are governed by the laws of the Dubai International Financial Centre (DIFC), UAE. Any disputes arising from these Terms or the use of Bachu shall be subject to the jurisdiction of the DIFC Courts.

17. Changes to Terms

We may update these Terms from time to time. Continued use after updates constitutes acceptance of the revised Terms. Material changes will be communicated through the site or via email.
